Eligibility Criteria

For Employers:

  • Hold a valid UK sponsor licence issued by the Home Office.
  • Offer a role that meets the minimum salary requirement, now set at £48,500 per year or 100% of the going rate for the occupation.
  • Ensure compliance with immigration sponsorship regulations, including maintaining records and fulfilling reporting duties.

For Employees:

  • Must have worked for their overseas employer for at least 12 months, unless they earn £73,900 or more, in which case they can transfer immediately.
  • The role must align with a recognised Standard Occupational Classification (SOC) code.

  • Employers must assign a CoS, an electronic record confirming job details, salary, and employment conditions.

  • Applications are submitted online, with costs now ranging from £284 to £1,235, depending on duration and employer size.

  • Applicants may need to attend a biometric appointment and undergo criminal record checks, depending on the industry.

Decision Timeline

  • The visa allows 5 years in any 6-year period for salaries below £73,900 and 9 years in any 10-year period for salaries above that threshold. Employers should apply well in advance to accommodate work schedules. 

Financial Obligations for Employers

Employers may be responsible for:

  • Immigration Skills Charge, based on company size and visa duration.
  • Healthcare surcharge and additional processing costs.

Family Sponsorship

While the Skilled Worker Visa previously allowed dependents to join visa holders, restrictions now apply to certain visa categories. Particularly for care workers, family members can no longer apply as dependents unless the worker was sponsored in the UK before March 11, 2024 and meets specific conditions.
